1. Introduction

2. Definitions

2.1. Account – a private profile that constitute a personal account that a User creates and manages on the Website.

2.2. Applicable Law – laws of Nigeria applicable to any and all disputes between the User and the Company under these Terms.

2.3. Claim – receiving a Prize or winnings through an online wallet.

2.4. Draw – a Game in which a draw determines the outcome.

2.5. Secure Electronic Technology Plc (also referred to as the "Company", "we", "us") – a company duly formed and incorporated under the laws of Nigeria to offer lottery services to website visitors.

2.6. Game – means the game services offered on the setlottonig.com platform

2.7. Game History – data that the Company keeps on the games that the User has played on his Account.

2.8. Lottery Rules – These are additional rules or guidelines that the Company has released that apply to games on the Website in addition to these Terms. They may contain, for example, the game's rules, cost, how the game is played, prize structure, and any other pertinent details.

2.9. Lottery Services – Any lottery and gambling services (publicly or privately) offered by the company using the lottery software.

2.12. Prize – A prize that a User has won using a ticket.

2.13. Registration – the process of creating an Account on the Website.

2.14. Subscription – is a purchase of extra services from the Company on a recurrent basis for a set amount.

2.15. Ticket – a way to enter a Game.

2.16. Top Up/Wallet Funding – Moving money to virtual wallet for playing purpose

2.17. Transaction History – data that the company keeps about transactions made with money from the user's account.

2.18. User (also known as "Player," "you," or "your") is the holder of an Account on the Website that has not yet been closed, suspended, or terminated.

2.19. Wallet – a secure electronic store for the value of the funds deposited or winnings won by the User linked to the User’s Account.

2.20. Website - refers to the website that the Company manages and owns at https://nationallotterynigeria.com. English shall be the sole official language of the Website.

2.21. Withdrawal – is when a user takes money out of their account balance.

 

3. Signing Up

3.1. Users must create an Account on the Website to participate in any of our games.

3.2. Users are only permitted to have one (1) Account each on the Website.

3.3. A User can create an Account only if the User is of sufficient age (18) to form legally binding contracts, possess the entire legal capacity, the ability, and is not prohibited or otherwise restricted from doing so by any Applicable Law, and is not a national or long-term resident of a nation designated by the National Financial Institution Unit and Economic Financial Crime Commission on Money Laundering as a high-risk jurisdiction.

3.4. It is the user’s responsibility to ensure that they comply with any and all laws applicable to them before registering or participating in any activity through the Website.

3.5. Every User must complete a registration process to create an Account. To create an Account, Users will be required to supply information, such as but not limited to the following:

i. phone and e-mail address

ii. full name and surname

iii. date of birth and gender

iv. address, country, state, city, zip code, and postal code

v. NIN(National Identification Number)

3.6. To demonstrate that a user meets the requirements outlined in Section 3.3, the Company may require further information which the User shall provide upon request.

3.7. The Company reserves the right to require Users to verify that they are eligible to register on the Website, to carry out checks or request information from Users from time to time (during and after registration) and to refuse, suspend or cancel registration of an account in its absolute discretion (for example, including but not limited to if a player provides any false, invalid or misleading information or where the conditions outlined in Section 3.3 are no longer met)

3.8. An application for Registration may be rejected by the Company for any reason.

3.9. Users residing or present in any jurisdiction where receipt of the Services would be a prohibited activity are not permitted to register on this site or receive the Services.

3.10. The accuracy of the information a user supplies to the website is strictly the User’s responsibility.

3.11. The User agrees that he will not create more than one Personal Account for personal use, nor create a Personal Account for third parties nor use other people's Personal Accounts. The User is personally responsible for the activities that are carried out on his Personal Account, and independently makes sure that his credentials (including password) do not get to third parties.

3.12. On completion of registration, Users will be notified through email that their account is open and they will be able to use the Website to purchase tickets for lotteries or services delivered by the Website in accordance with these Conditions.

4. Account Use

4.1. A user’s Account is solely for his use, and must be used personally.

4.2. The User is entirely responsible for the security of his Account's password

4.3. The User must report any unauthorized and illegal use of his Personal Account by third parties, as well as any information that indicates that the security of his Personal Account is threatened. Otherwise, all actions taken from the User's account are recognized as committed by him and are valid.

4.4. A user may reset his password by entering the email address you supplied when registering.

4.5. It is the User’s responsibility to keep the information related to your Account up to date. All the information stated in Section 3.5 should be updated in your Account settings.

4.6. The User has the right to delete his Personal Account at any time using the Tools available on the Site

4.7. A User can purchase any game offered by the Company on the Website. The Company reserves the right to modify and/or terminate the game. The Company shall notify its users of any modifications to or cancellations of games. In cases where the changed and/or cancelled game results in unfulfilled services, the Company shall refund Funds paid for the game.

 

5. Website Code of Conduct for Users

5.1. While using the Website, Users consent to:

i. not breach these Terms or any Applicable Law, which may include but is not limited to international laws, national laws, statutes, rules, etc., or aid any third party in violating these terms and such laws.

ii. not supply the Website with incorrect, inaccurate, incomplete, or misleading information.

iii. not infringe on the patent, copyright, trademark, or other intellectual property rights of any party,

iv. not uploading or otherwise using the Website to send viruses, Trojan horses, spyware, adware, or any other malicious code; performing DDoS attacks; or interfering with or disrupting any network, piece of equipment, or server connected to the Website in any way that could harm, disable, or overburden the Website.

v. not try to gain unauthorized access to the Website, other Accounts, computers, or networks connected to the Website, or to extract information from the Website,

vi. not use anybody else's personal Account or password, or disclose your Account or password with third parties,

vii. not to pose as anyone or falsely represent your relationship with another User, person or entity, or otherwise undertake any action that is fraudulent, dishonest, deceptive, or misleading in any other way; or create a personal Account on behalf of another person, company or entity unless you have the legal authorization to do so,

viii. not to violate these Terms and the Applicable law in any other way.

5.2. While using the Website, you also consent to:

i. use the Website for personal, non-commercial Use,

ii. play Games in accordance with the Applicable Law, these Terms, as well as the Lottery Rules,

iii. keep your personal password secure and confidential,

iv. keep your Account information up to date.

 

6. Account Wallet Funds, Spending, Play Limits, and Withdrawals

6.1. You can buy Tickets on the Website after depositing funds to your Account Wallet.

6.2. You can only buy Tickets using funds available in your Account Wallet

6.3. The Company retains the right to establish a minimum and maximum sum of money that may be added to the Account Wallet

6.4. The Company retains the right to place restrictions on how frequently you can play any of the Games in any given time frame.

6.5. Users’ must stick to the minimum threshold for DNFI (Designated Non Financial Institution)

6.5. All Prize winnings will be deposited into the User’s Winning Wallet.

6.6. You are solely responsible for withdrawing Winnings from your winning Wallet.

6.7. Withdrawals will be handled upon the submission of bank account information and completion of all required KYC procedures (ID scan and a utility bill confirming the bank account details).

6.8. The Company has the right to reverse any transactions that have resulted in a payment error. The participants to a transaction must make a mutual reparation when the transaction is cancelled.

 

7. Account Inactivity

7.1. Any funds deposited to your Account Wallet according to Section 6.1, are stored in your Account Wallet for 3 years starting from the day of the last login into the Account. Any funds left in your account Wallet after the expiry of 3 years since the last login into the Account, will be transferred into the prize fund.

7.2. The Company will take all reasonable measures to contact the owner of any Account in the period set forth in Section 7.1, using Account information.

 

8. Account Termination, Suspension, and Closure

8.1. It is your right to permanently terminate your Account at any time. You can do so by contacting us at +2347039224303 or wecare@setlottonig.com

8.2. The Company has the right to suspend your Account if you violate these Terms or fail to meet the requirements in Section 3.3. Games cannot be played on Suspended Accounts. You will be notified in the event your Account is suspended. You have seven (7) days from the time you receive notice of the suspension to reverse it. Your Account will be closed if you don't remove the suspension-related factors.

8.3. You cannot withdraw funds from the closed Account after Closure. The Company will take all reasonable measures to contact the owner of the closed Account in this period, using the User’s Account information.

 

9. Lottery Services

9.1. The Company offers lottery services in accordance with a license granted by the National Lottery Regulatory Commission.

9.2. The Company has the right to prohibit any individual from purchasing Tickets or using Lottery Services. Any Game may be suspended or withdrawn at any time by the Company. If the Company cancels a Draw, the Company will reimburse you for the cost of your entry ticket. This reimbursement will be made directly into your Account Wallet. Refunds do not bear any interest.

9.3. Tickets can only be purchased up to 10 minutes before any Draw. The Company may at any time make public the end of a specific Game. After the deadline, no tickets for that game will be sold.

9.4. The Company may provide free Tickets under terms that the Company will decide at its discretion.

9.5. A Ticket may be declared invalid by the Company when the Company reasonably believes that the Ticket was bought by or on behalf of a person who fails to meet the requirements set forth in Section 3.3 or has been subjected to any electronic manipulation as detailed in Section 5 or otherwise.

9.6. The right to a Prize cannot be transferred.

9.7. The Company will not be responsible or liable to anyone claiming a Prize that was paid to a person who used another person's identity to pretend to be the account holder for the relevant Account or payment account holder.

9.8. The Company will choose the day, time, frequency, and format for each Game's Draws. If a Draw is halted due to a malfunction of the equipment or for any other reason, the Draw will be finished in accordance with the appropriate draw rules for that Game. If a Draw cannot occur on the scheduled date or time, it will occur as soon as is practicable thereafter. A new draw shall be conducted in accordance with the relevant Draw Procedures if any Game draw is ruled illegal. Draw results will be stored in the Lottery System. Prizes will only be paid by the Company based on the official results of the relevant Draw, stored in the Lottery System. The Company reserves the right to decline any payment against any incorrectly announced number in any Draw.

 

10. Website Content

10.1. The Company may create and post content on the Website, such as text, photos, video, and audio files, as well as information (together referred to as the "Content").

10.2. The Company will not be held responsible for any modifications to the Website's content, which is subject to change at any moment.

 

11. Intellectual Property

11.1. The Company owns all the elements and contents of the website, including any content on its social media accounts, such as Facebook, Twitter, YouTube, and LinkedIn.

11.2. The Website, Content, and materials made available there are protected by copyright, trademarks, and trade secrets, among other things.

11.3. Secure Electronic Technology Plc, a corporation incorporated in accordance with the laws of Nigeria is the rightful owner of the lottery software utilized by the Company to deliver lottery services.

11.4. The Website and all of the Content on it are only for your personal, non-commercial use. Without our prior written approval, you are not permitted to duplicate, reprint, publish, edit, distribute, display, transmit, license, transfer, or otherwise use any of the Website's content or technology.

11.5. It is expressly forbidden to violate any of the Company's or the owner of the Lottery Software's intellectual property rights.

 

12. Links to other Third-Party Websites or Services

12.1. The Website might link to third-party websites or services that are not within the Company's control or ownership.

12.2. The Company has no control over, and accepts no liability for, any third-party websites or services' content, privacy policies, or practices. 13. Liability of the Parties

13.1 Unless expressly stated otherwise, the Company and You will each be independently held accountable for individual/respective actions, improper or non-performance of obligations under these Terms in accordance with these Terms and the Applicable Law.

The Company reserves the right to report violations that involve attempted deposits of monies to your Account in accordance with Section 6.1, including but not limited to money laundering, terrorism funding, and other criminal offenses.

 

14. Disclaimers and Limitation of Liability

14.1. There are no guarantees, conditions, or warranties as to the accuracy, quality, or suitability of the Content or Lottery Services on the Website. We make no promises regarding the reliability, error-free operation, or uninterrupted operation of our website.

14.2. You must cease using the website if you are not happy with its performance or other aspects. You waive any rights against the Company by using the Website.

14.3. Any liability for direct, indirect, incidental, special, punitive, or consequential damages whatsoever, including any that may result from:

(i) the accuracy, completeness, or content of this site, shall not be assumed by the company, its officers, directors, employees, agents, or any third-party service provider.

(vii) any interruption or cessation of services to or from this site or any sites linked (through hyperlinks, banner advertising or otherwise) to this site,

(viii) any viruses, worms, bugs, Trojan horses, or the like, which may be transmitted to or from this site or any sites linked (through hyperlinks, banner advertising or otherwise) to this site,

(ix) any loss or damage of any kind incurred as a result of your use of this site or the services found at this site, whether based on warranty, contract, tort, or any other legal or equitable theory, and whether or not the company is advised of the possibility of such damages.

14.4. Company shall not be responsible for any lost revenue, indirect loss, special loss, or consequential damage that you may suffer or incur because of the discontinuation of any game or your participation or non-participation in any game.

14.5. All content and services offered on the Website are given "as is" and without any kind of guarantee.

14.6. The Company performs all services provided and all business activities on its own behalf. The companies and platforms that are used to sell the lottery services are not sponsors of the lottery services or any other commercial endeavours (e.g., Apple, Google etc.).

 

15. Force Majeure

15.1. In case of any circumstances of insuperable force (i.e., events of extraordinary or insuperable nature) that have occurred and remain in effect beyond the Parties’ control and that a Party could neither foresee nor prevent for objective reasons, if these circumstances prevent a Party from proper fulfilment of its obligations hereunder, the term for fulfilment of such obligations hereunder shall be extended for the period of the effect of such circumstances of insuperable force.

15.2. The circumstances of insuperable force shall include wars and other military operations, earthquakes, floods, and other natural disasters, adoption of laws and regulations by state and local authorities, failure of power supply, technological challenges/ network interruptions or communication system or other similar circumstances that prevent the Parties from the proper fulfilment of their obligations hereunder.

15.3. A Party that has no way to properly fulfil its obligations hereunder due to circumstances of insuperable force shall notify the other Party of such circumstances and the estimated period of their effect, in writing, within seven (7) calendar days from the occurrence of the circumstances (enclosing evidence that proves existence of the circumstances). Otherwise, a Party at fault shall lose a right to refer to the circumstances of insuperable force as to a basis for non-performance of its obligations hereunder.

 

16. Confidentiality and Privacy Policy

16.1. By accessing and/or using the Website, you hereby consent to the collection, storage, use and disclosure of your personal information in accordance with the Applicable Law.

16.2. Any personal information that you provide to the Company and any information about your use of the Website obtained thereof will be subject to our Privacy Policy.

16.4. In an event you win a Prize, if required by law, the Company shall provide the third party with details of any Prize won/claimed by or paid to you.

16.5. The terms your usage is strictly confidential and should not be unduly disclosed to none parties.

16.6. You agree to exhaust all remedial options provided herein and you shall not disclose any disagreement without first exhausting all the options contained in this agreement.

 

17. Discretion

17.1. The Company's discretion, as reasonably exercised within the provisions of these Terms and Conditions as well as the Applicable Law, is final and binding.

17.2. The User agrees that any information related to his activities on the Site can be used in accordance with the "Privacy Policy."

 

18. Applicable Law and Dispute Resolution

18.1. These Terms and condition may be governed and construed in accordance with the laws, regulations or guidelines of the Federal Republic of Nigeria or other regulations which is applicable in Nigeria.

18.2. The Parties shall endeavour to resolve through negotiations and/or mediation all disagreements that may arise between the Company and the User during the validity term hereof.

18.3. The User agrees that for the purposes of resolving disputes between the User and the Company call/text with the authorized persons of the Company through 2347039224303 or wecare@setlottonig.com shall be effective and binding means of communication.

18.4. In the event the Parties are unable to settle a dispute by negotiation and/or mediation within 30 days, it shall be referred to Arbitration in accordance with the provisions of the Arbitration and Conciliation Act, Laws of the Federal Republic of Nigeria. The Arbitration shall be conducted by a Sole Arbitrator mutually agreed upon by the parties and failing such appointment to be appointed by the Chairman, Chartered Institute of Arbitrators, (UK), Nigeria Branch. The place of the arbitration shall be Abuja, Nigeria and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on the Parties. Judgement upon the award rendered by the arbitrator may be entered in any court having jurisdiction. The costs of the arbitrator shall be divided equally between the Parties.

 

19. Final Provisions

19.1. All Users agree to abide by these Terms and Conditions when they use the Website.

19.2. Users may at any time stop using the Website and Lottery Service.

19.3. These Terms and Conditions shall remain in force unless otherwise terminated by the Company. The Company may terminate these Terms at any time at its own discretion without any recourse to any User.

19.4. If any questions and/or issues have not been regulated by these Terms and Conditions, they shall be regulated under the Applicable Law.

19.5. These Terms and Conditions, our Privacy Policy and Lottery Rules constitute the entire agreement between you and us depending on your use of the Website.
